The first phase of Project F received an
allocation of credits in 2019, pursuant to
an application filed March 15, 2019,
which does not describe the multiphase
composition of the project. An
application for tax credits for the second
phase of Project F is filed with the
allocating agency by the same entity on
March 15, 2021. Credits are allocated to
the second phase of Project F on
October 30, 2021. The aggregate amount
of credits allocated to the two phases of
Project F exceeds the amount of credits
that may be allocated to an applicant in
one year under the allocating agency’s
QAP. The second phase of Project F is,
therefore, NOT eligible for the increase
in basis accorded a project in a 2019
DDA, since it does not meet all of the
conditions for a multiphase project, as
defined in this notice. The original
application for credits for the first phase
did not describe the multiphase
composition of the project. Also, the
application for credits for the second
phase of Project F was not made in the
year immediately following the first
phase application year.

Executive Order 13132 (entitled
‘‘Federalism’’) prohibits an agency from
publishing any policy document that
has federalism implications if the
document either imposes substantial
direct compliance costs on state and
local governments and is not required
by statute, or the document preempts
state law, unless the agency meets the
consultation and funding requirements
of section 6 of the executive order. This
notice merely designates DDAs and
QCTs as required under IRC Section 42,
as amended, for the use by political
subdivisions of the states in allocating
the LIHTC. This notice also details the
technical methods used in making such
designations. As a result, this notice is
not subject to review under the order.

Background
With some exceptions, the ESA
prohibits activities that constitute take
of listed species unless a Federal permit
is issued that allows such activity. The
ESA’s definition of ‘‘take’’ includes such
activities as pursuing, harassing,
trapping, capturing, or collecting in
addition to hunting, shooting, harming,
wounding, or killing.
A recovery permit issued by us under
section 10(a)(1)(A) of the ESA
authorizes the permittee to conduct
activities with endangered or threatened
species for scientific purposes that
promote recovery or for enhancement of
propagation or survival of the species.
These activities often include such
prohibited actions as capture and
collection. Our regulations
implementing section 10(a)(1)(A) for
these permits are found in the Code of
Federal Regulations at 50 CFR 17.22 for
endangered wildlife species, 50 CFR
17.32 for threatened wildlife species, 50
CFR 17.62 for endangered plant species,
and 50 CFR 17.72 for threatened plant
species.

Proposed activities in the following
permit requests are for the recovery and
enhancement of propagation or survival
of the species in the wild. The ESA
requires that we invite public comment
before issuing this permit. Accordingly,
we invite local, State, Tribal, and
Federal agencies and the public to
submit written data, views, or
arguments with respect to these
applications. The comments and
recommendations that will be most
useful and likely to influence agency
decisions are those supported by
quantitative information or studies.
