In accordance with the
Paperwork Reduction Act of 1995, we,
the Bureau of Indian Affairs (BIA), are
proposing to renew an information
collection.

SUPPLEMENTARY INFORMATION: In
accordance with the Paperwork
Reduction Act of 1995, we provide the
general public and other Federal
agencies with an opportunity to
comment on new, proposed, revised,
and continuing collections of
information. This helps us assess the
impact of our information collection
requirements and minimize the public’s
reporting burden. It also helps the
public understand our information
collection requirements and provide the
requested data in the desired format.
We are soliciting comments on the
proposed ICR that is described below.
We are especially interested in public
comment addressing the following
issues: (1) Is the collection necessary to
the proper functions of the BIA; (2) will
this information be processed and used
in a timely manner; (3) is the estimate
of burden accurate; (4) how might the
BIA enhance the quality, utility, and
clarity of the information to be
collected; and (5) how might the BIA
minimize the burden of this collection

Abstract: This information collection
is necessary for the BIA to authorize
rights-of-way to cross land held in trust
or restricted status on behalf of
individual Indians and Tribes, for a
specific purpose, including but not
limited to building and operating a line
or road. The statutory authority for this
program is at 25 U.S.C. 323–328. The
regulations at 25 CFR 169 implement
the statutory authority. The BIA uses the
information it collects to determine
whether or not to grant a right-of-way,
the value of the right-of-way, the
appropriate compensation due to
landowners, the amount of
administrative fees that must be levied,
and the penalties, if any, that should be
assessed for violations of the right-ofway provisions.

ACTION:
The Oregon State University,
Department of Anthropology and the
Oregon Parks and Recreation
Department (OPRD) have completed an
inventory of human remains and
associated funerary objects, in
consultation with the appropriate
Indian Tribes or Native Hawaiian
organizations, and have determined that
there is a cultural affiliation between the
human remains and associated funerary
objects and present-day Indian Tribes or
Native Hawaiian organizations. Lineal
descendants or representatives of any
Indian Tribe or Native Hawaiian
organization not identified in this notice
that wish to request transfer of control
of these human remains and associated
funerary objects should submit a written
request to the OPRD. If no additional
requestors come forward, transfer of
control of the human remains and
associated funerary objects to the lineal
descendants, Indian Tribes, or Native
Hawaiian organizations stated in this
notice may proceed.
DATES: Lineal descendants or
representatives of any Indian Tribe or
Native Hawaiian organization not
identified in this notice that wish to
request transfer of control of these
human remains and associated funerary
objects should submit a written request
with information in support of the
request to the OPRD at the address in
this notice by May 24, 2019.
