In accordance with 5 CFR 1320, OMB is filing comment and withholding approval at this time. The agency shall examine public comment in response to the proposed rulemaking and will include in the supporting statement of the next ICR--to be submitted to OMB at the final rule stage--a description of how the agency has responded to any public comments on the ICR, including comments on maximizing the practical utility of the collection and minimizing the burden. OMB requests that EPA submit the following as supplemental documents for the information collection associated with the final rule: the regulatory text that includes the ICR; the regulatory text that includes the submission instructions; all documents referenced in the SS-A to support estimates of the burden (e.g. TSD), and screen shots of the electronic portal where the reporting requirements will be submitted online to EPA. OMB expects in the final supporting statement that all cost and labor numbers referenced in the supporting statement tables include footnotes with citations to the underlying data used to generate the numbers in the tables including labelling when expert judgment was used. Lastly, OMB requests that EPA submit a summary table in the supporting statement that explains the change in burden compared to the last time EPA promulgated a rule-making to make it clearer what burden is changing in this rule compared to the last rule. This table should include the rows and columns that are in the ICR summary table in ROCIS and a clear explanation for the increase or decrease in each table cell.

This ICR reflects the combined burden of NSPS OOOOa if both the 2018 NSPS OOOOa Reconsideration Proposal amendments and the 2019 NSPS OOOOa EO 13783 Review Proposal Amendments are Finalized. The 2018 NSPS OOOOa Reconsideration Proposal addresses issues raised in petitions and provide clarity, streamlining and alignment of requirements leading to an overall burden reduction to the regulated community. The 2019 NSPS OOOOa EO 13783 Review Proposal Amendments would remove sources in the transmission and storage segment from the source category and will lead to a reduction in the recordkeeping and reporting burden due to eliminating requirements for these sources. The information collected will be used by EPA and delegated state and local agencies to determine the compliance status of sources in production and processing still subject to the rule.
