SUPPORTING STATEMENT


A. Justification:


1. 47 CFR Section 73.1560(d) requires that licensees of AM, FM or TV stations file a notification with the FCC when operation at reduced power will exceed ten consecutive days and upon restoration of normal operations. If causes beyond the control of the licensee prevent restoration of authorized power within a 30-day period, an informal written request must be made for any additional time as may be necessary to restore normal operations.


The Commission is requesting an extension of this information collection to receive the full three- year OMB approval/clearance for the collection.


This information collection does not affect individuals or households; thus, there are no impacts under the Privacy Act.


Statutory authority for this collection of information is contained in Section 154(i) of the Communications Act of 1934, as amended.


2. FCC staff use the data to maintain accurate and complete technical information about a station’s operation. In the event that a complaint is received from the public regarding a station’s operation, this information is necessary to provide an accurate response.


3. This is a notification/informal filing. We do not believe the use of information technology is feasible in this situation.


4. This agency does not impose a similar information collection on the respondents. There is no similar data available.


5. In conformance with the Paperwork Reduction Act of 1995, the Commission is making an effort to minimize the burden on all respondents. Therefore, this collection of information will not have a significant impact on small businesses/entities.


6. The frequency for this collection of information is determined by respondents, as necessary.


7. This collection of information is consistent with 5 CFR 1320.5(d)(2).


8. The Commission published a Notice (84 FR 37285) in the Federal Register on July 31, 2019 seeking comments from the public on the information collection requirements contained in this collection. No comments were received from the public.


9. No payment or gift was provided to respondents.


10. There is no need for confidentiality with this collection of information.


11. This collection of information does not address any private matters of a sensitive nature.



12. We estimate that 80 stations will file notifications of operation at reduced power. The average burden on licensees is one (1) hour of consulting with outside engineer per notification. This estimate is based on FCC staff's knowledge and familiarity with the availability of the data required.

Total Number of Annual Responses: 80 Notifications/Informal Written Request


Total Annual Burden Hours: 80 AM, FM or TV stations x 1 notification/hr = 80 hrs.


Annual “In-House” Cost: We assume that the respondents would contract out with a consulting engineer to prepare the notifications/informal written requests. We estimate that the respondents would have an average salary of $100,000/year @ $48.08/hour.


80 notifications/informal written requests x 1 hour x @ $48.08 = $3,846.40

13. Annual Cost Burden: We assume that the respondents would contract out with a consulting engineer to prepare the notifications/informal written requests. We estimate that the engineer would have an average salary of $250.00/hour and spend 1 hour per notification.


80 notifications/informal written requests x 1 hour @ $250.00 = $20,000.00


14. Cost to the Federal Government: The Commission will use professional staff at the GS-11/5 level ($37.79/hour) and the GS-5/5 level ($20.61/hour) to process these notifications.


0.75 hours x $37.79 x 80 notifications = $2,267.40

0.25 hours x $20.61/hour x 80 notifications = 412.20

$2,679.60

Total Cost to the Federal Government: $2,679.60


15. There are no program changes or adjustments to this information collection.


16. The data will not be published.


17. OMB approval of the expiration of the information collection will be displayed at 47 C.F.R. Section 0.408.


18. The Commission published a Federal Register Notice seeking comments on the information collection requirements contained in this collect (81 FR 76942) on November 4, 2016. In the notice, the annual cost was stated as none. With this submission, we correct that cost to read “$20,000.” There are no other exceptions to the certification statement.
