Abstract: rule 211(h)-1 under the Investment Advisers Act of 1940 (17 CFR 275.211(h)-1) (the “Advisers Act”) would require investment advisers registered with the Commission to (1) exercise due diligence on retail investors before approving retail investor accounts to invest in leveraged/inverse investment vehicles, (2) adopt and implement policies and procedures reasonably designed to achieve compliance with the proposed rule’s provisions, and (3) to meet certain related recordkeeping requirements.
