In accordance
with 5 CFR 1320.13, this information collection is approved for 6
months as an emergency clearance to meet licensees' needs during
changed operations due to COVID-19. NRC will seek comment from the
public on this new collection after clearance. If the NRC decides
to continue use of the collection past the approved emergency
clearance time period, it must resubmit an ICR to OMB under the
normal PRA clearance process and include responses to any public
comments it has received.

The U.S. Nuclear Regulatory Commission
(NRC) requires licensed facilities to comply with requirements in
Title 10 of the Code of Federal Regulations (CFR) as they relate to
the safe and secure use of nuclear materials; medical, industrial,
and academic applications; uranium recovery activities, low-level
radioactive waste sites; and the decommissioning of previously
operating nuclear facilities and power plants. These requirements
can be found in 10 CFR Parts 20, 30, 31, 32, 33, 34, 35, 36, 37,
39, 40, 50, 70, 71, 72, 74, 75, and 150. The ability of licensed
facilities to comply with these requirements may be negatively
impacted by the Coronavirus Disease 2019 (COVID-19) Public Health
Emergency (PHE). To facilitate licensees’ requests for exemptions
to the requirements in the above regulations, the NRC is providing
an online form to submit the required information for a specific
exemption request.
The U.S. Nuclear

2019 (COVID-19) Public Health Emergency (PHE). To facilitate
licensees’ requests for exemptions to the requirements in the above
regulations, the NRC is providing an online form to submit the
required information for a specific exemption request. The NRC is
requesting emergency review of the information collection because
this information is essential to the mission of the agency and is
needed before the expiration of the normal time limits under the
Office of Management and Budget’s regulations at 5 CFR 1320 that
implement the provisions of the Paperwork Reduction Act of 1995.
The NRC cannot reasonably comply with the normal clearance
procedures because an unanticipated event (COVID-19 PHE) has
occurred. The NRC is requesting OMB approval of this new
information collection for a period of 6 months. The development of
exemption requests is covered by existing information collections.
This information collection only addresses the burden to complete
and submit the online form. This information collection applies to
holders of nuclear materials licenses (including byproduct
material, uranium recovery, decommissioning (both materials and
reactors), fuel facilities, and spent fuel storage licenses) who
may need to seek regulatory relief during the COVID-19 PHE.
This is a new clearance. NRC
staff anticipates that the agency will receive 470 exemption
requests via the NRC Online Form, “Nuclear Materials Exemption
Request,” resulting in 940 hours of burden to licensees.
On behalf of this Federal agency, I certify that
the collection of information encompassed by this request complies
with 5 CFR 1320.9 and the related provisions of 5 CFR
1320.8(b)(3).
The following is a summary of the topics, regarding
the proposed collection of information, that the certification
covers:
(i) Why the information is being collected;
(ii) Use of information;
(iii) Burden estimate;
(iv) Nature of response (voluntary, required for a
benefit, or mandatory);
(v) Nature and extent of confidentiality; and
(vi) Need to display currently valid OMB control
number;
If you are unable to certify compliance with any of
these provisions, identify the item by leaving the box unchecked
and explain the reason in the Supporting Statement.
