Abstract: The Federal Trade Commission seeks an additional three-year clearance for the information collection requirements in its Fuel Rating Rule (or Rule). This Rule establishes standard procedures for determining, certifying, and disclosing the octane rating of automotive gasoline and the automotive fuel rating of alternative liquid automotive fuels, as required by the Petroleum Marketing Practices Act. 15 U.S.C. 2822(a)-(c). The Rule also requires refiners, producers, importers, distributors, and retailers to retain records showing how the ratings were determined, including delivery tickets or letters of certification.

Short Statement: There is a slight adjustment downward for the estimated annual hours of burden (from 33,052 hours in 2017 down to 32,907 hours in 2020) and the annual labor costs (from $390,430 in 2017 down to $389,646 in 2020). This is attributable to a slight drop in covered entities for purposes of recordkeeping (161,000 fuel industry members in 2020 and 162,000 in 2017) and slight decrease in the number of entities affected by disclosure requirements (155,920 member retailers in 2020 and 156,418 member retailers in 2017). As set out in the supporting statement, only 1/8 of the member retailers are subject to the disclosure requirements in an individual year.
