Section 328 of the Clean Air Act gives the EPA responsibility for regulating air pollution from outer continental shelf (OCS) sources located offshore of the states along the Pacific and Atlantic Coasts, and along the eastern Gulf of Mexico coast (off the coast of Florida). The EPA promulgated regulations to control air pollution from OCS sources at 40 CFR part 55. Sources located within 25 miles of a state's seaward boundary must comply with the same state/local air pollution control requirements as would be applicable if the source were located in the corresponding onshore area (COA). Sources located more than 25 miles from a state's seaward boundary (25-mile limit) must comply with EPA air pollution control regulations. The owners and operators of new and modified OCS sources must prepare permit applications and, along with existing OCS sources, must conduct recordkeeping and reporting associated with permit requirements for testing, monitoring and report preparation. In addition, four local air pollution control agencies in California and four states on the Atlantic Coast have received, or are projected to receive, delegation of authority to implement and enforce the OCS permit program. These delegated state/local agencies conduct recordkeeping and reporting activities associated with reviewing and issuing permits to OCS sources in their jurisdictions and with observing tests, conducting inspections and reviewing reports for these sources.
The burden estimates for the OCS Air Regulations have been revised to reflect projections based on information obtained directly from EPA Regional Offices, delegated local agencies in California, and the BOEM web site have resulted in changes in the number, mix, and types of sources projected to occur in the upcoming clearance period.
