Meat and Poultry Interstate Shipment and Inspection Readiness Program (ISIRP)- Specific Terms and Conditions

In addition to the terms and conditions identified in the AMS General Terms and Conditions, the following terms and conditions apply for awards made through the ISIRP. In the situation that there is inconsistency between the AMS General Terms and Conditions and the ISIRP program specific terms and conditions, this document will take precedence.

1.0 Applicable regulations

As a condition of this award, the recipient assures and certifies that it will comply with the requirements contained in the AMS General Terms and Conditions and the following statutes and regulations, as applicable.

  2. 21 U.S.C. 451 – “Poultry Products Inspection Act

  3. 21 U.S.C. 683 – “Cooperative Interstate Shipment Program -Meat

  4. 21 U.S.C 472 – “Cooperative Interstate Shipment Program – Poultry”

  5. 9 CFR Parts 301 through 381- “Mandatory Meat and Poultry Products Inspection and Voluntary Inspection and Certification

  6. 9 CFR Parts 416 through 500 – “Regulatory Requirements under the Federal Meat Inspection and the Poultry Products Inspection Act

  7. 9 CFR Parts 530 through 561 – “ Mandatory inspection of Fish of the order Siluriformes and Products of Such Fish

  8. 9 CFR Parts 590 through 592 – “Egg Products inspection

2.0 Allowable and Unallowable Cost and Activities

Cost Category

Description, Guidance and Exceptions

Building and Land- Construction

Allowable for the acquisition of buildings, facilities, or land or to make additions, improvements, modifications, replacements, rearrangements, reinstallations, renovations, or alterations of an existing building or facility (including site grading and improvement, and architecture fees). This also includes construction and construction-related materials, which may include, but are not limited to, the purchase of building materials such as wood, nails, concrete, asphalt, roofing, gravel, sand, paint, insulation, drywall, or plumbing.

Equipment

Allowable with prior approval for acquisition costs of general-purpose equipment. Recipients should consider rental cost of general-purpose equipment as their first option.

Allowable for the acquisition of special purpose equipment.

Compensation for Damage

Unallowable for recipients to receive compensation for injuries or damage to property arising from project activities.

Marketing Costs

Unallowable for recipients to use funds for marketing their product(s) or organization.



3.0 No Cost Extension

The recipient must have received a federal meat or poultry inspection or acquired a cooperative interstate shipment program (CIS) certification within 36 months of the initial period of the grant agreement in order to avoid having to return awarded funds. A no cost extension will not be granted to meet this requirement. A recipient may request a no cost extension of up to 12 months from the end of the period of performance to complete project objectives. The request must be submitted 10 days prior to the ending date of the grant agreement.

4.0 CONSTRUCTION AND EQUIPMENT

ISIRP recipients are encouraged to purchase only American-made equipment and products, per Executive Order 13858. Recipients are encouraged to use, to the greatest extent possible, iron and aluminum as well steel, cement, and other manufactured products produced in the U.S in every contract, subcontract, purchase order or subaward.

Title to nonexpendable equipment purchased with award funds will vest in the recipient upon completion of the award project and acceptance by AMS of required final reports. Please refer to section 12.0 of AMS General Terms and Conditions for equipment disposition instructions.

5.0 real property

The recipient cannot encumber property acquired or improved as part of the grant award and must follow the requirements of 2 CFR 200.311 before disposing of the property. The real property will be used for the originally authorized purpose as long as needed for that purpose. When real property is no longer needed for the originally authorized purpose, the recipient must obtain disposition instructions from AMS. The following alternatives will apply:


a. Retain title after compensating the Federal awarding agency as described in 2 CFR Part 200.311(c)(1);

b. Sell the property and compensate the federal awarding agency as specified in 2 CFR Part 200.311(c)(2); or

c. Transfer title to the Federal awarding agency or to a third Party designated/approved by the Federal awarding agency as specified in CFR Part 200.311(c)(3).

6.0 Performance Monitoring and reports

The recipient is responsible for monitoring the day-to-day progress of the project and reporting to AMS any setback or delays in accomplishing their project objectives. Interim performance reports, final performance reports and federal financial report are due as specified in section 10 of AMS General Terms and Conditions. AMS will withhold payments under this award if the recipient is delinquent in submitting required reports.

7.0 Award closeout

In addition to the closeout requirements stated in section 14.0 of AMS General Terms and Conditions, the recipient must submit the following documentation to demonstrate they have successfully met the project and program goals.

  1. Federal Grant of Inspection Certification

  2. Proof of obtaining and participating in the Cooperative Interstate Shipment program

  3. If unable to fulfill the goals of the project, an official letter signed by the AOR demonstrating the actual efforts rendered by the recipient towards compliance with the program requirements.



According to the Paperwork Reduction Act of 1995 (44 U.S.C. § 3501 et seq), an agency may not conduct or sponsor, and a person is not required to respond to a collection of information unless it displays a valid OMB control number. The valid OMB control number for this information collection is 0581-NEW. The time required to complete this information collection is estimated to average 2 hours per response, including the time for reviewing instructions, searching existing data sources, gathering and maintaining the data needed, and completing and reviewing the collection of information.
