Subject: Non-Substantive Change Request – Sponsor Review Procedures for Unaccompanied Alien Children (OMB #0970-0278)

This memo requests approval of a non-substantive change to the approved information collection, Sponsor Review Procedures for Unaccompanied Alien Children (OMB #0970-0278).

Background

The Sponsor Review Procedures for Unaccompanied Alien Children (UAC) information collection contains four instruments that allow ORR to collect information necessary to determine the suitability of a proposed sponsor for an unaccompanied child as required by the Homeland Security Act (6 U.S.C. 279), the Trafficking Victims Protection Reauthorization Act of 2008 (8 U.S.C. 1232), and the Flores Settlement Agreement (No. CV85-4544-RJK (C.D. Cal. 1996)). The collection was last approved by OMB on September 17, 2020 and expires on June 30, 2022.

Overview of Requested Changes

Revisions to Instruments

For all instruments, ORR adjusted placement of the OMB number, OMB expiration date, and PRA statement so that they all appear of the first page of the instrument. ORR also added contact information in the PRA statement.

In addition, ORR made the following revisions:

Authorization for Release of Information (FRP-2 & FRP-2s)

• Added an instruction to review the Privacy Notice (FRP-11A & FRP-11As).

• Updated the footnote to reflect the most recent Consolidate Appropriations Act.

• Removed requirement to submit proof of citizenship; this information is no longer needed.

• Changed the term “unaccompanied alien child (UAC)” to “unaccompanied child (UC)” throughout the instrument.

• Fixed a few spelling errors in the Spanish version.

Family Reunification Application (FRP-3 & FRP-3s)

• Added/edited language for clarifying on pages 1, 2, 9, and 10.

• Changed instructions for the “Adult Who Will Care for the Minor(s) if You Cannot” section to be more inclusive and better match language in ORR policy.

• Removed references to the Sponsor Declaration; ORR discontinued use of this document.

• Fixed a few spelling errors in the Spanish version.

Fingerprinting Instructions (FRP-7& FRP-7s)

• Changed the term “designated ORR Digital Fingerprint Site” to “designated digital fingerprint site” throughout the instrument. The instrument needs to use a more general term to reflect the forthcoming option to schedule appointments at digital sites not funded by ORR.

• Added language clarifying that there is no fee to be fingerprinted at a designated digital fingerprint site.

Letter of Designation for Care of a Minor (FRP-9 & FRP-9s)

• Added a footnote clarifying that individuals don’t have to be U.S. citizens or hold an immigration status to sponsor a child.

• Changed the term “unaccompanied alien child (UAC)” to “unaccompanied child (UC)” throughout the instrument.

• Fixed a few spelling errors in the Spanish version.

Revisions to Supplemental Materials

ORR made the following revisions to its Privacy Notice (FRP-11A & FRP-11As) at the request of the Federal Bureau of Investigation (FBI):

• Added language specifically addressing the fact that ORR shares fingerprints with the FBI for the purpose of conducting fingerprint-based background checks.

• Added a footnote describing DHS’ restrictions on using sponsor information.

• Added links to FBI’s Privacy Act Statement and notice titled Noncriminal Justice Applicant’s Privacy Rights.

Revision to Information Collection Title

ORR is proposing to change the name of the information collection from “Sponsor Review Procedures for Unaccompanied Alien Children” to “Family Reunification Packet for Sponsors of Unaccompanied Children.”
