This is a request for approval of an emergency information collection that solicits from State educational agencies (SEAs) maintenance of equity (MOEquity) data in response to requirements under the American Rescue Plan (ARP) Elementary and Secondary School Emergency Relief (ESSER) Fund. Section 2004(b) of the ARP Act introduced new MOEquity requirements that SEAs and LEAs must comply with in order to receive ARP ESSER funds. The new MOEquity requirements are central to the Departmentâs commitment to ensuring that essential resources are meeting the needs of students who have been subject to longstanding opportunity gaps in our education system. These student groups have also experienced the greatest impacts from the Coronavirus Disease 2019 (COVID-19) pandemic. In addition, without this collection, the Department will not be able to carry out its oversight responsibilities of the $122 billion while also ensuring that SEAs receive the resources they need to immediately address COVID-19-related needs.
If this collection is not allowed to proceed, the Department will not be able to carry out its oversight responsibilities of the $122 billion while ensuring that LEAs and schools receive the resources they need to immediately address COVID-19-related needs, such as returning students and educators to in-person instruction and addressing the impact of interrupted education on all students and particularly those disproportionately impacted by the pandemic.
This is a new emergency collection request. The burden increase is a program change due to a new statute, the ARP Act, which requires SEA and LEA ARP ESSER fund recipients to meet the MOEquity requirements that will result in 78 burden hours and a cost of $3,455.40 to the public.
