Eligibility

You may apply for asylum if you:
- Submit an application for asylum within 1 year of arriving in the United States, unless you can establish
that there are changed circumstances that materially affect your eligibility for asylum or extraordinary
circumstances directly related to your failure to file within 1 year.
Failure to file the Form I-589 within 1 year of your last arrival in the United States may also delay your
eligibility for employment authorization or result in the denial of your application for employment
authorization.

Simply filing an application for asylum does not entitle you to employment authorization or to work in the
United States.
You may include in your asylum application your spouse and/or any children who are under 21 years of
age and unmarried, if they are in the United States.

Removal from the United States – Applicants in the United States unlawfully are subject to removal if
their asylum or withholding claims are not granted by an asylum officer or an immigration judge.
Use of Information in Your Application – Any information provided in completing this application may be

For purposes of this section,
an asylum application is
frivolous if any of its material
elements is deliberately
fabricated.

Frivolous Applications – Applicants determined to have knowingly made a frivolous application for asylum
will be permanently ineligible for any benefits under the Immigration and Nationality Act (INA). You may
not avoid a frivolous finding simply because someone advised you to provide false information in your
asylum application. See section 208(d)(6) of the INA and Title 8 of the Code of Federal Regulations (CFR)
sections 208.20 and 1208.20.
Failure to Appear for Interview or Biometrics Appointment – If filing with U.S. Citizenship and Immigration
Services (USCIS), unexcused failure to appear for an appointment or to provide biometrics (such as
fingerprints) and other biographical information within the time allowed may delay eligibility for
employment authorization and result in an asylum officer dismissing your asylum application or referring
it to an immigration judge. Applicants and eligible dependents in removal proceedings who fail, without
good cause, to provide USCIS with their biometrics or their biographical information as required within
the time allowed may have their applications found abandoned by the immigration judge. See section
208(d)(5)(A) of the INA and 8 CFR sections 208.10, 1208.10, 1003.47(d).

You can only ask for employment authorization (permission to work in the United States) if your asylum
application is still pending 365 days after it was filed with USCIS. If your asylum application is denied
before the 365-day period has passed, you will not be granted employment authorization.
You can submit an application for a work permit by filing a Form I-765, Application for Employment
Authorization. Carefully follow the instructions and submit the form with proof that you have a pending
asylum application.
Each family member included in your application who wants permission to work must submit a separate
Form I-765.
If you are granted asylum, you will be allowed to work in the United States and do not have to apply for
employment authorization. You can apply for an Employment Authorization Document (work permit) if
you want evidence that you are allowed to work in the United States as a result of being granted asylum.

Asylum process

File the I-589

When you submit your Form I-589 and evidence online, you will immediately receive a receipt notice. You
will be able to track your case and see all USCIS notices in your account. We will notify you by email
and/or text message with any updates.

Attend your biometric
services appointment

After submitting your application, you will receive a biometric services appointment notice. At the
appointment, you will provide your fingerprints, photograph, and signature so that USCIS can verify your
identity and conduct background and security checks, including a check of criminal history records
maintained by the Federal Bureau of Investigation (FBI), before making a decision on your application.

Attend the interview

After submitting your application, you will receive a notice for your asylum interview.
If you do not speak English fluently, you must bring an interpreter with you to your interview. Your
interpreter must be at least 18 years of age and be fluent in English and your language.

Receive your asylum
decision

At the end of your asylum interview, we will let you know how you will receive the decision in your case.

As part of applying for asylum, you must provide evidence to support your application. These documents
help us determine if you are eligible for asylum and verify your answers.
Do not send us original documents in the mail. Provide legible copies of your documents unless we later
ask for original documents.
You may amend or supplement your application before or at the time of your asylum interview with an
asylum officer and at your hearing in Immigration Court by providing additional information and
explanations about your asylum claim. For asylum applications
filed with USCIS, submit any documentary evidence at least 14 calendar days before your interview with
an asylum officer. Extensions to submit additional evidence may be granted by USCIS on a discretionary
basis. Any such extension will be treated as an applicant-caused delay in the adjudication of your asylum
application. Any applicant-caused delay will result in denial of your application for employment
authorization if the delay is unresolved at the time you file for employment authorization. See 8 CFR
sections 208.7.

Dependent identification
For each family member you are including in your application as a dependent (spouse or children), you
must upload proof of their identity and your relation to them. For all other family members, uploading

Upload a copy of each page (cover to cover) of your passport, other travel documents, and any U.S.
immigration documents.

Family identification
Upload documents that prove the identity of each family member you are not including as a dependent
and your relationship to them.

Proof of identity may include a copy (every page) of each relative’s passport, other travel documents, and
any U.S. immigration documents.

application and explaining that you are now independently filing for asylum.
Written statement
Your written statement should include events, dates, and details of your experiences that relate to your
claim for asylum.
Specific claim of eligibility
Upload evidence showing the specific facts that support your claim.
- Evidence may include newspaper articles, affidavits of witnesses or experts, medical and/or
psychological records, doctors' statements, periodicals, journals, books, photographs, official documents,
or personal statements or live testimony from witnesses or experts.
- You may also upload an affidavit (statement or letter) from at least one person for each event you are
trying to prove. Affidavits may be provided by relatives or others. Persons providing affidavits need not be
U.S. citizens or lawful permanent residents.
- If you have difficulty discussing harm you have suffered in the past, you may wish to submit a health
professional's report explaining this difficulty.
- If evidence supporting your claim is not reasonably available or you are not providing such corroboration
at this time, you must explain why and upload this explanation.

Criminal history
Aliens who have been convicted of a particularly serious crime are not eligible for asylum. For
applications filed on or after April 1, 1997, the conviction may have occurred either inside or outside of
the United States. If you have been arrested in the United States you must submit a certified copy of all
arrest reports, court dispositions, sentencing documents, and any other relevant documents. You must be
prepared to provide the original upon request. If they are not available, upload an explanation of why
documents are not available.

When answering the following questions about your asylum or other protection claim (withholding
of removal under 241(b)(3) of the INA or withholding of removal under the Convention Against
Torture), you should provide a detailed and specific account of the basis of your claim to asylum or

Eligibility
To qualify for asylum, you must establish that you are a refugee who is unable or unwilling to return
to his or her country of nationality, or last habitual residence if you have no nationality, because of
persecution or a well-founded fear of persecution on account of race, religion, nationality,
membership in a particular social group, or political opinion. This means that you must establish
that race, religion, nationality, membership in a particular social group, or political opinion was or
will be at least one central reason for your persecution or why you fear persecution. If you are
granted asylum, you and any eligible spouse or child included in your application can remain and
work in the United States and may eventually adjust to lawful permanent resident status. If you are
not granted asylum, the Department of Homeland Security (DHS) may use the information you
provide in this application to establish that you are removable from the United States.

Additional Information
You must clearly describe any of your experiences, or those of family members or others who have
had similar experiences that may show that you are a refugee.
If you have experienced harm that is difficult for you to write down and express, you must be aware
that these experiences may be very important to the decision-making process regarding your
request to remain in the United States. At your interview with an asylum officer or hearing with an
immigration judge, you will need to be prepared to discuss the harm you have suffered. If you are
having trouble remembering or talking about past events, we suggest that you talk to a lawyer, an
accredited representative, or a health professional who may be able to help you explain your

Request for Information (RFI). You can respond to our request and upload your

We encourage you to submit all your supporting evidence when you submit your
application.
If you are providing evidence after you have submitted your application but before your
interview, use the unsolicited evidence option on the Documents tab related to the Form
I-589 you submitted.
You may amend or supplement your application before or at the time of your asylum
interview with an asylum officer and at your hearing in immigration court by providing
additional information and explanations about your asylum claim. For asylum
applications filed with USCIS, submit any documentary evidence at least 14 calendar days
before your interview with an asylum officer. We may grant extensions to submit
additional evidence on a discretionary basis. We will treat these extensions as an
applicant-caused delay when adjudicating your asylum application. Any applicant-caused
delay will result in us denying your application for employment authorization if the delay
is unresolved when you file for employment authorization.
