Clarification

Purpose of Clarification

Add attestation that initial applicant is organized under
the laws of a state.

To be consistent with the MA application and
emphasize the importance of the requirement that
applicants be validly organized under the laws of a
state.
To clarify the difference in the requirements under
the regulation and so that organizations can
indicate whether they are subject to the 24 month
or 38 month bans separately. See 42 CFR §§
423.507, 423.508, 423.509, and 423.510.
