4. The completed Covenant of Purpose, Use, and Ownership document has been
recorded in the appropriate jurisdiction.
5. If required by EDA, an opinion of Recipient’s counsel has been provided to
substantiate that the Covenant of Purpose, Use and Ownership was validly
executed and properly recorded.
6. A signed statement from the Recipient’s counsel confirming that
there is a legal impediment that prevents granting EDA a first priority lien and
explaining the nature of this legal impediment is also included.
