Explanation of a Non-Substantive Change to OMB Control Number 3060-1270:

• FCC Form 5640, 5641

• Purpose of this Submission: This submission is to make a non-substantive change request to existing information collections pursuant to 44 U.S.C. § 3507. The Commission seeks to change the FCC Form 5640 and FCC Form 5641(OMB Control No. 3060-1270).

Summary of Updates to the FCC Forms

• Revised Form Certifications: Previously, the Federal Communications Commission (FCC) sought and obtained approved from the Office of Management and Budget for multiple information collections needed to implement the Secure and Trusted Communications Networks Reimbursement Program (Reimbursement Program), OMB Control No. 3060-1270. The various filings are submitted using the FCC Form 5640 and 5641. To further protect the Reimbursement Program from waste, fraud, and abuse and to align the certifications with other recently implemented funding programs by the FCC, the FCC’s Wireline Competition Bureau revised the certifications associated with the FCC Form 5640. See Wireline Competition Bureau Announces Best Practices for Equipment Disposal and Revises FCC Form 5640 Certifications for the Secure and Trusted Communications Networks Reimbursement Program, WC Docket No. 18-89, Public Notice, DA 21-1234 (WCB Sept. 30, 2021). Although the revised certifications are exempt, pursuant to 5 CFR § 1320.3(h)(1), from the requirements of the Paperwork Reduction Act of 1995, Public Law 104-13, we submit this change to update the FCC Forms 5640 and 5641 to reflect the revised certifications.
