1. Justification for a No Material/Non-Substantive Change.

FMCS is updating its form required by section 8(d)(3), of the Labor Management Relations Act, 1947. There were two changes. The first is the format of the submission.

29 CFR § 1402.1 now requires filers to file electronically unless such submission creates an undue hardship, in which case the filer may contact the FMCS Notice Processing Office to explain the circumstances and receive assistance.

The second change is a variety of non-substantive changes to titles and questions that will help FMCS better serve the public by providing FMCS better information on the parties and the labor dispute.

2. Describe the changes from the currently Active ICR.

The new rules require online submission unless there is an undue hardship.

The following are the changes made to the form:

• Renumbered and moved some questions around for better grouping

• Some field names were updated but field remains the same

• Updated- Industry selections have been updated

• Updated- Employer Rep name broken into first and last name fields

• Updated- Changed Bargaining Unit Size number into a drop down

• Updated- Union Rep name broken into first and last name fields

• Updated- Filing Rep name broken into first and last name, and title fields

• Updated- Official Filing This Notice field broken into first and last name, title, email, and phone fields

• Updated- Notice Filing Instructions, only includes electronic filing

• Updated- Field name of Notice Type and selections

• Updated- Privacy Act Statement

• Updated- Instructions on Page 2

• Removed- Employer Rep Title field
