Description of Changes to VA Forms 40-1330 and 40-1330M

ISSUE: The Biden Administration issued three Executive Orders with requirements to advance equality and inclusion to assess service to beneficiaries in particular groups. After receiving consultation from OMB, NCA revised certain forms to comply with OMB guidance.

The following forms had minimal non-substantive changes to the Sex block to align with current OMB guidance. Further, minimal non-substantive changes were made to certain other blocks. This change request is non-substantive and has no impact on the burden. These changes will not result in any changes to the burden because they will not affect the number of individuals that will apply, the annual burden hours, or affect the time needed to complete the forms.

Description of Changes to VA Form 40-1330M, Claim for Government Medallion for Placement in a Private Cemetery (OMB # 2900-0222)

The Department of Veterans Affairs (VA) National Cemetery Administration (NCA) is proposing changes to VA Form 40-1330M, Claim for Government Medallion for Placement in a Private Ceremony.

NCA is making the following non-substantive text edits to the form:

• Block 5: add check box for UNSPECIFIED OR ANOTHER GENDER IDENTITY

• Update language to active voice throughout the General Information Sheet

• Update HOW TO SUBMIT A CLAIM with new VA Direct Upload method

• Update mailing address and new electronic method of submitting claims on General Information Sheet and Coversheet

• Block 10: Add new branches of service to show SPACE FORCE, PUBLIC HEALTH SERVICE, and NATL OCEANIC AND ATMOSPHERIC ADMIN

• Removed Block 6 as the age of the Veteran can be calculated using the dates of birth and death

• Block 13 is now separated into two: Blocks 12 and 13

• Blocks 17 and 18 are now combined as Block 17; the same information is being asked, just in a slightly different manner

VA will update the date of the form once OMB approval of the proposed changes is received.

Description of Changes to VA Form 40-1330, Claim for Standard Government Headstone or Marker (OMB # 2900-0222)

The Department of Veterans Affairs (VA) National Cemetery Administration (NCA) is proposing changes to VA Form 40-1330, Claim for Standard Government Headstone or Marker.

NCA is making the following non-substantive text edits to the form:

• Block 6: add check box for UNSPECIFIED OR ANOTHER GENDER IDENTITY

• Update language to active voice throughout the General Information Sheet

• Addition of new emblems of belief consistent with 38 U.S.C. § 2306(c) and 38 CFR §§ 38.630(b) and 38.632(b)(2).

• Update mailing address and new electronic method of submitting claims on General Information Sheet and Coversheet

• Addition of information and picture of upright marble headstone, bronze niche marker, light grey granite and marble markers, and new Prisoner of War inscription on markers, consistent with 38 U.S.C. § 2306(c) and 38 CFR § 38.630(a).

• Update example in Optional Items to show Korea and Korean War rather than Vietnam and Vietnam War

• Update HOW TO SUBMIT A CLAIM with new VA Direct Upload method

• Removed Block 7 as the age of the Veteran can be calculated using the dates of birth and death

• Add Block 13 to identify the deceased as a Prisoner of War or Former Prisoner of War

• Block 15: Add new branch of service to show SPACE FORCE

• Block 20 is now separated into two: Blocks 20 and 21

• Blocks 21 and 22 are now combined as Block 22; the same information is being asked, just in a slightly different manner

• Rearrange Block 26 - 33

VA will update the date of the form once OMB approval of the proposed changes is received.
