Supplemental Document: Justification for a no material/non-substantive change


OMB 1140-0015 (Application for Tax Exempt Transfer and Registration of Firearm – ATF Form 5 (5320.5);

  1. Correction of minor grammatical errors and typos

  2. Capitalization of titles of officials and persons

  3. Removed the following sentence from Section 12; Information for the Chief Law Enforcement Officer- “A “Yes” answer to items 14.a. through 14.h. or 18.d. or 18.e. could disqualify a person from acquiring or possessing a firearm. Also, ATF will not approve an application if the transfer or possession of the firearm is in violation of State or local law.”

  4. Updated Definitions in Section 1.R to read as follows: “victim, or by a person who has a current or recent former dating relationship with the victim (as defined in 18 U.S.C 921(a)(37)).”

  5. Modified Question 14.e as follows: “On or after the age of 16, have you ever been adjudicated as a mental defective OR have you ever been committed to a mental institution?’”
