safely. The agency determined that it is
usual and customary for manufacturers
to mark (for example, ‘‘On’’ and ‘‘Off,’’
and ‘‘Open’’ and ‘‘Close,’’ etc.) all
manually controlled valves and
switches to meet the requirements of the
American National Standards Institute’s
(ANSI) standards. Therefore, OSHA is
taking no burden hours or cost for these
paperwork requirements.
Disclosure of Records
OSHA determined that employers
disclosing information to OSHA during
an inspection is outside the scope of the
PRA because OSHA would only review
records in the context of an open
investigation of a particular employer to
determine compliance with the
Standard. See 5 CFR 1320.4(a)(2).

384,107 remains the same.

request to OMB to extend the approval
of the information collection
requirements.

I. Background
The Department of Labor, as part of
the continuing effort to reduce
paperwork and respondent (i.e.,
employer) burden, conducts a
preclearance consultation program to
provide the public with an opportunity
to comment on proposed and
continuing information collection
requirements in accordance with the
Paperwork Reduction Act of 1995 (PRA)
(44 U.S.C. 3506(c)(2)(A)). This program
ensures that information is in the
desired format, reporting burden (time
and costs) is minimal, the collection
instruments are clearly understood, and
OSHA’s estimate of the information
collection burden is accurate. The
Occupational Safety and Health Act of
1970 (OSH Act) (29 U.S.C. 651 et seq.)
authorizes information collection by
employers as necessary or appropriate
for enforcement of the OSH Act or for
developing information regarding the
causes and prevention of occupational
injuries, illnesses, and accidents (29
U.S.C. 657). The OSH Act also requires
that OSHA obtain such information
with minimum burden upon employers,
especially those operating small
businesses, and to reduce the maximum
extent feasible unnecessary duplication
of effort in obtaining information (29
U.S.C. 657).
The following sections describe who
uses the information collected under
each requirement, as well as how they
use it. The Cranes and Derricks
standard’s information collection
requirements impose a duty on
employers to produce and maintain
records that implement controls and
take other measures to protect workers
from hazards related to cranes and
derricks used in construction.
Accordingly, construction businesses
with workers who operate or work in
the vicinity of cranes and derricks must
have, as applicable, the following
documents on file and available at the
job site: Equipment ratings, employee
training records, written authorizations
from qualified individuals, and program
qualification audits. During an
inspection, OSHA will have access to
the records to determine compliance
under conditions specified by the
standard. An employer’s failure to
generate and disclose the information
required in this standard will affect
significantly the agency’s effort to
control and reduce injuries and fatalities

hours. The increase is due to the

equations. Also, the agency is requesting
an adjustment increase in capital costs
from $2,547,063 to $2,811,282, an
increase of $264,219.
OSHA will summarize the comments

will include this summary in the
request to OMB to extend the approval
of the information collection
requirements.
