The 60-day comment period for the Part D Drug Management Program (DMP) Information
Collection Request (ICR) closed on July 5, 2024. CMS received one public comment.
Comment: The commenter requested that CMS revise the Second Notice to include variable text to
reference the date a limitation begins and ends, instead of stating that the limitation ends one year
from the date of the notice. The commenter explained that they prefer to provide enrollees with
information in advance, instead of on the effective date, and further explained that at times an
updated notice may be required after a limitation has begun, in both cases making text specifically
referencing “one year from the date of this notice” as inaccurate.
CMS response: CMS thanks the commenter for this feedback. CMS recognizes the need for
flexibility when referencing limitation effective and end dates in the Second Notice, specifically
when providing information to an enrollee prior to starting a limitation or when revising or updating
a notice. Including variable text fields will provide sponsors with the flexibility needed to ensure that
dates referenced in the Second Notice are accurate. For these reasons, CMS will revise the Second
Notice to include variable text to reference the effective and end dates for limitations.
