Purpose of Form

This form is used to amend a pending application related to an international section 214 authorization: ITC-214, ITC-ASG, ITC-DSC, ITC-FCN, ITC-MOD, ITC-RPT, ITC-STA, ITC-T/C, and ITC-WAV. An amendment is filed when the Applicant needs to make a material change in the pending application.

Who Must File This Form and When

Every entity seeking to amend a pending ITC application must use this form to amend the information provided in the application if such information is no longer substantially accurate and complete in all significant respects. The Applicant must file the amendment as promptly as possible and in any event within thirty (30) days from when the change in information occurred (including thirty (30) days from a request by Commission staff for additional information).

Description of Form

This form consists of a main form which will bring up the information filed in the application to be amended. The Applicant should make the required changes. There is an ability to file attachment(s) if the changed information pertains to a previously submitted attachment. The Applicant is encouraged to upload a single document in machine readable format, including all required information. The Applicant must fill in all required fields, upload required documents, make all required certifications, and sign the form before submitting the application.

Information Current and Complete

Information filed in the application with the Commission must be kept current and complete under section 1.65 of the Commission’s rules. Section 63.50 of the Commission’s rules permits the applicant or the party to the application as a matter of right to amend any application prior to the date of any final action taken by the Commission and must notify the Commission regarding any substantial and significant changes in the information furnished in the application while it remains pending. 47 CFR § 63.50.

The Applicant can file a further amendment to a submitted application by filing a separate ITC-AMD form.

Applicable Rules and Regulations

Section 63.50 of the Commission’s rules allows for the amendment of pending applications.

Any application may be amended as a matter of right prior to the date of any final action taken by the Commission or designation for hearing. Amendments to applications shall be signed and submitted in the same manner, and with the same number of copies as was the original application. If a petition to deny or other formal objections have been filed to the application, the amendment shall be served on the parties. 47 CFR § 63.50.

The requirements for applications related to international section 214 authorizations can be found in 47 CFR §§ 63.11, 63.13, 63.18, 63.19 and 63.24.

Applicant(s) should refer to the Debt Collection Improvement Act of 1996. The Debt Collection Act requires all federal agencies ensure that no debtors to the Federal government obtain any licenses or other benefits from the FCC. To ensure this, the Commission must collect FRN information to correlate its Applicants with any outstanding Federal debt that they might have incurred in other dealings with the Federal government. Other International Section 214 (ITC) Forms

  • ITC-214 Form.

    • This form is used to request authority under section 214 to provide international services.

  • ITC-ASG/TC Form.

    • This form is used for an assignment of an international section 214 authorization or the transfer of control of an authorization holder. The form is used for both substantive and pro forma transactions.

  • ITC-DSC Form.

    • This form is used to notify the Commission of an international section 214 authorization holder’s intention to discontinue, reduce or impair international service.

  • ITC-MOD Form.

    • This form is used to modify an existing international section 214 authorization, for example to add or remove a condition on an existing authorization.

  • ITC-FCN Form.

    • The form is used by a licensee to notify the FCC of new foreign carrier affiliations.

  • ITC-RPT Form.

    • This form is used to file the reports required for a carrier classified at dominant for the provision of particular services on particular routes due to an affiliation with a foreign carrier with market power in a destination country in accordance with section 63.10(c) of the Commission’s rules.

  • ITC-STA Form.

    • This form is used to request Special Temporary Authority related to an international section 214 authorization, such as to provide service prior to grant of the authorization or related to an unauthorized transaction related to the authorization.

  • ITC-WAV Form.

    • This form is used to request a waiver of the Commission rules related to an international section 214 authorization.

FILING INSTRUCTIONS

Remember to save your draft application periodically by clicking the save button. ICFS will time-out out after 15 minutes of no activity, and failure to save will result in loss of any information entered into the application form after the last save.

Item A.1. The file number for the application that is being modified will be pre-populated here, based on the application you selected for amendment.

Item A.2. The Applicant must check the box to acknowledge that it has attached a narrative statement describing the changes to the application being made in this amendment. The Applicant must also upload an attachment that describes the changes being made to the underlying application. For example, state “This is an application to amend a pending ITC-ASG application to update the ownership information.”

Note: The remainder of the amendment application form will look the same as the form for the original application that the Applicant is amending, and it will be pre-populated with all the information that the Applicant previously provided for the questions in the underlying application, with three exceptions that will be blank in the amendment and will need to be completed: (1) the application description question, (2) the General Certification Statements section, and (3) the signature block.

For example, if the Applicant is amending an ITC-T/C application, ICFS will display the underlying ITC-T/C application that the Applicant previously filed, with all the fields populated as originally submitted (with the three exceptions noted above). The Applicant should change any information that it needs to, and/or upload any new or revised attachments.
