In the quality section of the
online reporting tool, states
are required to report on
performance of health and
welfare, qualified providers,
and any other quality
performance measure with a
performance level of less
than 86%. Additionally,
outside of the online form,
states are required to provide
an aggregated report of
individual instances of
abuse, neglect, exploitation,
and remediation actions
taken.

Type of
Change
The quality section of the
online reporting tool will pull
in each of the state’s quality
performance measures
approved in the corresponding
section 1915(c) waiver. States
will be required to provide data
as evidence for each of those
performance measures. The
updated quality section will
include a feature allowing
states to attach additional
supporting documentation and
will include a specific section
for the aggregated abuse,
neglect, and exploitation
report.

Revision

Reporting on each of the
waiver's quality performance
measures on an annual rolling
basis will allow early
detection of deficiencies so
more timely action can be
taken. It will also eliminate
the need for states to provide
three years’ worth of data
during the waiver cycle.
Instead, CMS will utilize the
data provided in the annual
report to complete the midwaiver-cycle quality review
report.

Burden Change
There is a slight burden
increase because the
total number of 1915(c)
waivers increased from
153 to 159. Please
note, in 2021 the PRA
included information
about planned changes
to the quality section of
the online 372 reporting
tool that will require
states to provide data as
evidence for each of the
waiver’s performance
measures. The changes
have not yet been
implemented but are
expected to become
effective in calendar
year 2024. The change
in burden for the
updated 372 reporting
requirements were
included in the previous
PRA approval so do not
affect the burden of this
PRA renewal.
