NIOSH Human Subjects Contacts, including the Institutional Review Board Chair and
Co-Chairs, are authorized to make regulatory determinations for NIOSH activities.
I have reviewed the provided documentation for the subject activity and determined that
it does not meet the definition of research as defined by the Federal Policy for the
Protection of Human Subjects at 45 CFR 46.102 (l). Research is a systematic
investigation, including research development, testing, and evaluation, designed to
develop or contribute to generalizable knowledge. The purpose of the activity is to collect
information from covered employees experiencing designated illnesses incurred as a
result of their employment-based exposures to radiation, beryllium, or silica while in the
performance of their duties and use this information to make individual determinations on
compensation. As the purpose is to make individual determinations on compensation, this
activity is not intended to be generalizable and is therefore determined non-research.
