Instructions
a. Prior authorization from ATF to transport interstate or in foreign commerce
a destructive device, machine gun, short-barreled rifle, or short-barreled
shotgun is required under the provisions of 18 U.S.C. § 922 (a)(4) and 27
CFR 478.28. Persons wishing to transport interstate such items for longterm (more than one year) or permanent move, or temporary foreign
export, must submit a written request to ATF. You may submit a letter
containing all information required on this form in lieu of the form.

The ATF Form 5320.20 will be returned to the registered owner by email,
available for download on eForms, or sent by mail. Approval authorizes
the registered owner to transport the designated firearm(s) only during the
time period specified in Item 3. THE AUTHORIZATION DOES NOT
CARRY OR GRANT IMPORT RELIEF FROM ANY STATUTORY OR
REGULATORY PROVISIONS RELATING TO FIREARMS OTHER
THAN 27 CFR 478.28.

b. The registered owner of NFA firearm(s) must complete ATF Form 5320.20
and submit it to the Director, ATF. You can email the form to
[email protected], or submitted through the ATF eForms system. Or it can be
submitted via facsimile to the NFA Division at (304) 616-4501, or mailed to
the Director, Bureau of Alcohol, Tobacco, Firearms, and Explosives; 244
Needy Road; Martinsburg, WV 25405 (Attention: NFA Division).

f.

In the event Item 2 is checked “yes” and the firearm(s) is not returned to
the original location by the date specified, the registered owner must
submit a new application on ATF Form 5320.20 to receive approval to
return the firearm(s).

g.

If a contract or common carrier is used to transport the firearm(s), a copy of
ATF Form 5320.20 must be furnished to the carrier and must be in the
carrier's possession for the duration of the transportation. This will meet
the requirements of sections 922(e) and (f) of the Gun Control Act of 1968.

h.

The continuation sheet can be used to list additional firearms in excess of the
six listed on page 1 of the ATF Form 5320.20.

c. Signatures generated by the ATF eForms system, handwritten ink
signatures, and electronic signatures are permissible.
d. Item 4a should be the prior NFA control number stamped on the approved
NFA form from when the firearm was originally registered to the registered
owner listed in Item 1.

Privacy Act Statement
This information is provided pursuant to sections 3 and 7(b) of the Privacy Act of 1974 (5 U.S.C. § 552a(e)(3)):
1. Authority: The Bureau of Alcohol, Tobacco, Firearms, and Explosives (ATF) is authorized to solicit this information under 18 U.S.C. § 922(a)(4) of the Gun Control
Act of 1968 and 26 U.S.C. § 6103. ATF is authorized to collect this information to evaluate requests to transport certain National Firearms Act (NFA) firearms or
devices across state lines or to export them temporarily. ATF’s implementing regulations are at 27 CFR 478.28.
2. Purpose: ATF uses the information collected on ATF Form 5320.20, Application to Transport Interstate or to Temporarily Export Certain NFA Firearms, to determine
whether transporting or exporting the proposed NFA-regulated firearm or device is consistent with federal, state, and local law. This information also enables ATF to
monitor compliance with statutory transport restrictions and to assist in public safety and regulatory oversight.
3. Routine uses: ATF may disclose the information as permitted by the Privacy Act of 1974 (5 U.S.C. § 552a) and in accordance with System of Records Notice (SORN)
JUSTICE/ATF-008 – Regulatory Enforcement Record System. It may be shared with federal, state, local, tribal, and foreign law enforcement, or regulatory agencies, to
verify eligibility, support lawful enforcement and compliance activities, or for administrative or judicial proceedings. Information classified as tax return information is
protected from unauthorized disclosure under 26 U.S.C. § 6103.
4. Disclosure: Providing this information is mandatory under 18 U.S.C. § 922(a)(4) if a person wishes to transport or export an NFA firearm or device. Failing to provide
complete and accurate information may delay processing your request or result in ATF denying your application to transport or export the firearm or device.

Paperwork Reduction Act Notice
This form is in accordance with the Paperwork Reduction Act of 1995. The requested information is used to determine the applicant’s eligibility to temporarily transport
or export firearm(s) listed on this application. Collected data is also used to compile statistics on the manufacture and exportation of firearms. The furnishing of this
information is mandatory (18 U.S.C. § 921(g)).
The estimated average burden associated with this collection of information is ten minutes per respondent or record-keeper, depending on individual circumstances.
Comments concerning the accuracy of this burden estimate and suggestions for reducing this burden should be addressed to Reports Management Officer, Resource
