PURPOSE To provide a means for the loan applicant, or the loan applicant and the seller if land is being acquired, to request title examination, loan closing, and related legal services from approved attorney/title company, and to make clear who is to pay the fee. UNITED STATES DEPARTMENT OF AGRICULTURE RURAL DEVELOPMENT FARM SERVICE AGENCY (Location) REQUEST FOR TITLE OPINION AND LEGAL SERVICES Date: Dear The undersigned hereby request(s) you to prepare a title opinion and perform loan closing and other legal services in accordance with instructions and requirements of the Agency, particularly RD Instruction 1927-B (7 CFR Part 1927, Subpart B) including the disbursal of any funds that I am required to provide in connection with the transaction by the Agency. The Agency is furnishing you a description of the real property to be mortgaged. It is understood that the fee (insert applicable statement or statements from the following): has been agreed to by you and the undersigned. will have to be agreed to by you and the undersigned. is to be a reasonable figure to be set by you in accordance with your usual charges for comparable services. (Insert any other agreement regarding the fee if above items are not appropriate.) Subject to that understanding: the undersigned loan applicant(s) agree(s) to be responsible for payment of your entire fee if the security to be mortgaged to the Agency is not to include real estate acquired in connection with the loan; and if real estate is to be acquired the undersigned seller(s) agree(s) to be responsible for payment of % of the fee and the undersigned loan applicant agrees to be responsible for payment of the other % of the fee. It is understood that no liability or responsibility for payment of any portion of the fee is assumed by the Government, or by any Government officer, employee, or agency, or by the insured lender if this is an insured loan. Public reporting for this collection of information is estimated to be approximately 10 minutes per response, including the time for reviewing instructions, searching existing data sources, gathering, and maintaining the data needed, completing, and reviewing the collection of information. All responses to this collection of information are voluntary. However, in order to obtain or retain a benefit, the information in this form is required under 7 CFR 1927-B, Real Estate Title Clearance and Loan Closing. Rural Development has no plans to publish information collected under the provisions of this program.
