Title: Emergency Conservation Program and Biomass Crop Assistance Program
Declaration of Direct Final Rule
I am Requesting the Approval of this revised agency collection under the Farm Service Agency, and for
the Exception for the Application, to allow for Emergency Conservation Program and the Biomass Crop
Assistance Program, including this Request to the Secretary of the Department of Agriculture, to prescribe
the authorization under the TitleV of the Agriculture Act of 1949 as amended, for a modification to the
transfer or change of Interest in Lands Subject to Contract, for review and consultation. Effective
08/16/2026 for immediate effect upon review, by voluntary Consent, Authorization, Sole-Discretion,
Approval, by reference of incorporation by association and import, and for all purposes of the programs.
Per the regulations of the Agricultural Credit Act of 1978 as amended, and section 9011 of the Farm
Security and Rural Investment Act of 2002 as amended, to allow for assistance from programs due to
wild-fires, hurricanes, support for citizens of crop damaged by flooding, and other programs due to
damage related to major storms under the Office of Management and Budget and BCAP funding.
Activity related to BCAP did not change since the last Office of Management and Budget (OMB)
submission due to the lack of BCAP funding and ECP Requests for the timeframe 2024-2026.
Please accept this Direct Final Rule Determination under Rule-Making Policy under the Administrative
Procedure Act as amended, for the Approval and Implementation of the programs by the Farm Service
