Declaration of Final Rule for Enforcement Action
Title: Designation of Low Income Status
I am Requesting the Approval of this designation process by the National Credit Union Board under the
National Credit Union Act to authorize the NCUA Board to define low-income members so they credit
unions with membership serving predominantly low income members can benefit from criteria statutory
relief and receive assistance from the Community Development Revolving Loan Fund, on my behalf and
this written Designation Request for the Exemption for the Application, under Section 309 of the Riegle
Community Development and Regulatory Improvement Act of 1944, to establish an independent interagency appeals process to review appeals of material supervisory determinations made by NCUA Staff
and Sections 130 and 209 of the Federal Credit Union Act for the purposes of the intended to establish
appropriate safeguards for protecting insured credit unions from retaliation by NCUA staff. Effective
07/16/2026 for immediate effect upon review, by my Oath of my affirmation of my Approval,
Authorization, and voluntary Consent, with the approval of the Directors of the Office of Management
and Budget, to Carr out all purposes for the Safety and Security of Civilian Personnel of the Armed
Forces of the Federal Government of the United States.
Please accept my Final Determination of Rule Making Policy under the Administrative Procedure Act as
amended, to carry out the Air Force Rehabilitation under the Fish and Wildlife Service and the
Department of the Interior’s Section 313 exemption of the Federal Water Pollution Act as amended, for
