This ICR supports the recordkeeping, reporting, and labeling requirements for the manufacture and distribution of infant formula. Respondents to this collection are infant formula manufacturers who must ensure that their products adhere to the quality control provisions and procedures found in FDA regulations, and that nutrient information and directions for use are disclosed in their product labeling.
US Code:
21 USC 301 et seq.
Name of Law: Federal Food, Drug, and Cosmetic Act (FFDCA)
We have revised the information collection to include recommended activities and attendant burden found in the draft guidance titled âNotifying FDA of a Permanent Discontinuance in the Manufacture or an Interruption of the Manufacture of an Infant Formulaâ (December 2024). At the same time, we have removed burden attributable to the guidance âInfant Formula Transition Plan for Exercise of Enforcement Discretionâ (September 2022) as we are no longer experiencing disruptions in the supply of infant formula in the United States and therefore did not extend the guidanceâs end date. Cumulatively the change results in 96 fewer responses and 3,129 fewer burden hours annually. We have made no adjustments or changes to any other of the information collection elements.
On behalf of this Federal agency, I certify that the collection of information encompassed by this request complies with 5 CFR 1320.9 and the related provisions of 5 CFR 1320.8(b)(3).
