Trout, MD, MHS Chief, Hazard Evaluations and Technical Assistance Branch, NIOSH Health Hazard Evaluation investigations conducted pursuant to 42 C.F.R. Part 85 are generally not considered human subjects research and therefore do not require review and approval by an Institutional Review Board (IRB) under 45 C.F.R. Part 46. For a small number of projects where the investigation is non-exempt human subjects research, those investigations require individual IRB review and approval.
