Organizational Interest
The CNMI Growers Association (CNMIGA.ORG)
respectfully submits these comments in
response to the 30-day notice published in the
Federal Register on August 19, 2026 (91 FR
___; FR Doc. 2026-16863), concerning the
extension, without change, of the information
collection for E-Verify+. CNMIGA is a Saipanbased advocacy organization dedicated to the
integrity of federal labor and immigration
programs in the Commonwealth of the
Northern Mariana Islands (CNMI) and Guam,
the prioritization of United States citizens and
lawful permanent residents in the local labor
market, and the elimination of systemic fraud,
wage suppression, and exploitation that have
characterized certain segments of the foreignworker pipeline for more than a decade.
CNMIGA’s interest in this collection is direct
and operational. The CNMI remains uniquely
dependent on the CW-1 transitional worker
program, while also hosting meaningful
numbers of H-1B and H-2B workers.
Manpower agencies and employers in the
region routinely operate across these
categories. The verified federal prosecution
record demonstrates that petition fraud,
document falsification, passport confiscation,
unpaid overtime, and downstream absorption
of unauthorized workers have occurred with
disturbing regularity. Strict, mandatory,
audited E-Verify participation—uniformly
applied across CW-1, H-1B, and H-2B—is not
merely a paperwork convenience; it is a
structural enforcement tool that closes
category-shopping incentives, generates
continuous employer-level compliance data,
and supports the risk-based auditing that the
Department of Labor Office of Inspector
General (DOL-OIG) has repeatedly found
missing from foreign-labor programs.
Although the present notice is limited to an
extension of an existing collection, the
Paperwork Reduction Act factors invite
comment on practical utility, burden accuracy,

Response:
DHS appreciates your support of the E-Verify
program as a tool for ensuring lawful employment
in the United States and its outlying possessions.
DHS appreciates the attached reports and request
for investigation included in this public comment.

fraud to the Department of State online at:

CNMIGA addresses each of those factors
below while simultaneously placing the
collection in its real-world CNMI/Guam
enforcement context. The Association urges

USCIS and DHS to treat the continued
operation of E-Verify+ not as a static
demonstration project but as a living
enforcement infrastructure that must be
strengthened, uniformly mandated in the
CNMI and Guam, and actively crossreferenced with DOL debarment and fraud
findings.
