Public Service Loan Forgiveness (PSLF) & Temporary Expanded PSLF (TEPSLF) Certification and Application

The Department of Education (Department) is requesting an emergency clearance for this revision of the information collection, 1845-0110. Additionally, we are requesting that the full clearance package be filed at the same time and that the Department will initiate the 60-day public comment period upon notification of emergency approval. Final Regulations published on October 31, 2025 (90 FR 48966), 34 CFR 685.219(i) require an update to the currently approved Public Service Loan Forgiveness Certification and Application, to comply with E.O. 14325, by revising the certification language to include an attestation, under penalty of perjury, that the employer has not engaged in any activity that has a substantial illegal purpose on or after July 1, 2026. The One Big Beautiful Bill Act (OBBA) signed into law on July 4, 2025 also made statutory changes that indirectly impact this collection by revising the loan repayment plans that qualify for the Public Service Loan Forgiveness Program, which are in effect July 1, 2026. This information collection was uniquely impacted by two sets of final rules that made significant changes to the Direct Loan program and, more specifically, the eligibility requirements for the PSLF program—the final rules published October 31, 2025 and final rules published May 01, 2026. Since both rules had consequences for the PSLF program, the Department was obligated to wait until the May 01, 2026 rules were published before analyzing this information collection for all required changes. Together, the timing of these legislative activities and changing requirements resulted in the Department being unable to make changes to the PSLF form earlier than May and created a race condition for implementing the changes by July 1. These unique circumstances made it impossible for the Department to both follow the requirements for rulemaking and submit the revisions to the information collection under the normal PRA clearance timeline by July 1.
