Approval and Promulgation of Fed. Implementation Plan for Managing Emissions from Oil and Natural Gas Sources on Indian Country Lands Within the Uintah and Ouray Indian Reservation in Ut.-(Final Rule)

This ICR covers information collection requirements in the final Federal Implementation Plan (FIP) for Manging Emissions from Oil and Natural Gas Sources on Indian Country Lands Within the Uintah and Ouray Indian Reservation in Utah (40 CFR Part 49, Subpart K, §§ 49.4169 thorugh 49.4184), herein referred to as the U&O FIP. The information collected will be used by EPA and the Ute Indian Tribe agency to determine the compliance status of sources subject to the rule. In the final action, EPA is promulgating a Reservation-specific FIP to establish enforceable control requirements for reducing VOC emissions from new, modified, and existing oil and natural gas production and natural gas processing activities on the Indian country lands within the Uintah and Ouray Indian Reservation in Utah (U&O Reservation). Specifically, EPA is issuing this rule to require owners and operators of new, modified, and existing oil and natural gas sources on Indian country lands within the U&O Reservation in the Uinta Basin to reduce emissions of VOC, from crude oil, condensate, and produced water storage tanks, from glycol dehydrators, from pneumatic pumps, from fugitive equipment leaks, from pneumatic controllers, and from tanker truck loading and unloading. Oil and natural gas sources may also contain other VOC-emitting units or activities that include, but are not limited to, compressors, evaporation ponds, two and three-phase separators, heater treaters, liquids unloading, turbines, and reciprocating internal combustion engines. This rule does not contain requirements for, or otherwise apply to, those types of equipment or activities. Additionally, the FIP’s new/modified source VOC emission control requirements are generally consistent with those requirements under the New Source Performance Standards (NSPS) for the Oil and Natural Gas Sector at 40 CFR Part 60, subparts OOOO and OOOOa (NSPS OOOO/OOOOa), and the Federal Implementation Plan for Managing Air Emissions from True Minor Sources in Indian Country in the Oil and Natural Gas Production and Natural Gas Processing Segments of the Oil and Natural Gas Sector at 40 CFR Part 49 (National O&NG FIP). The costs associated with the monitoring, recordkeeping and reporting for new/modified sources is calculated under the existing ICRs for NSPS OOOO and OOOOa. The potential respondents are owners or operators of oil and natural gas sources found on Indian country lands throughout the U&O Reservation. For the purposes of the U&O FIP, an oil and natural gas source consists of all the air pollution emitting units and activities located on or integrally connected to a stationary source engaged in the extraction and production of oil and natural gas and/or the processing of natural gas, including the wells and all related processes used in the extraction, production, recovery, lifting, stabilization, and separation or treatment of oil, water, and/or natural gas (including condensate). Oil and natural gas production and processing components may include, but are not limited to: Wells and related casing head; tubing head and “Christmas tree” piping; pumps; compressors; heater treaters; separators; storage vessels; pneumatic devices; stationary engines; natural gas sweetening; truck loading; dewpoint suppression skids; natural gas dehydrators; completion and workover processes; gathering pipelines and related components that collect and transport the oil, natural gas and other materials and wastes from the wells or well pads; and natural gas processing plants. In general, owners or operators are required to maintain records of all oil and natural gas required monitoring and rule compliance. These reports and records are essential in determining compliance, and are required of all sources subject to the U&O FIP.
