Safety Standard for Adult Portable Bed Rails

The U.S. Consumer Product Safety Commission (Commission or CPSC) published in the Federal Register (88 FR 46958) the Safety Standard for Adult Portable Bed Rails (Standard), a final rule that establishes a mandatory safety standard for adult portable bed rails (APBRs), intended to address the unreasonable risk of injury and death associated with entrapment and other hazards from APBRs. The mandatory safety standard incorporates by reference ASTM F3186-17, Standard Specification for Adult Portable Bed Rails and Related Products, with modifications, and the requirements are codified at 16 CFR part 1270. This rulemaking is authorized by the Consumer Product Safety Act, 15 U.S.C. §§ 2051 – 2084. CPSC data show that 90% of injuries associated with adult portable bed rails are from entrapment of the head, chest or neck. Since 2021, CPSC has recalled more than 3 million adult portable bed rails through nine recalls and safety warning notices. At least 18 entrapment deaths are associated with the recalled bed rails. Sections 9 and 11 of ASTM F3186-17 contain requirements for labels, warnings, and instructional literature. The Standard includes minor modifications to these requirements. These are information collection requirements that are subject to public comment and review by the Office of Management and Budget (OMB) under the Paperwork Reduction Act of 1995 (PRA; 44 U.S.C. § 3501–3521).
