THE EXPORT ADMINISTRATION REGULATIONS
REQUIRE THAT ADEQUATE FACTS BE PROVIDED TO THE OFFICE OF EXPORT
ADMINISTRATION CONCERNING THE TERMS AND CONDITIONS OF THE ORDER
FROM BOTH THE APPLICANT AND THE PERSON IN THE U.S. WHO DEALT
DIRECTLY WITH THE FOREIGN PURCHASER. THE LATTER U.S.PERSON MUST
PROVIDE ASSURANCES THAT ALL OF THE DOCUMENTS AND RECORDS INVOLVED
IN THE NEGOTIATION WILL BE RETAINED BY HIM AND MADE AVAILABLE TO
THE OFFICE OF EXPORT ADMINISTRATION WHEN REQUIRED

1320.8(b)(3).
