THE MINERAL LEASING ACT OF 1920 (30
U.S.C. 181,226) PROVIDES THAT LANDS WHICH ARE NOT WITHIN ANY KNOWN
GELOLGICAL STRUCTURE OR A PRODUCING OIL OR GAS FIELD SHALL BE
LEASED WITHOUT COMPETITIVE BIDDING TO THE QUALIFIED PERSON JUST
MAKING AN APPLICATION FOR A LEASE. THE IMPLEMENTIVE REGULATIONS IN
43 CFR 3110 ESTABLISHES PROCEDURES FOR OBTAINING SUCH
NON-COMPETITIVE LEASES: OVE-THE-COUNTER (OTC) FILINGS BY WHICH THE
APPLICANT/OFFER OR SELECTS A PARCEL(S
