This request for
clearance is returned without approval. The DOL supplementary
statement of July 9 was not fully responsive to the OMB request for
additional information. Specifically, the sample of 145,000 units
was not supported by a description of procedures and required
variances. Accordingly, the requested sample size cannot be
evaluated. Further, a sample of 145,000 units appears excessive in
light of the requlatory purposes to be served by the study. Also,
the memorandum appears to indicate that DOL would also use the
State sample units for purposes of making fatality estimates. This
approach is unacceptable in that using such dat would necessitate a
Federal reporting requirement on the State sample members.
Moreover, OSHA requires immediate reporting of all fatalities.
Accordingly, the need for fatality data is already served.
