Abstract: RESIDENT ALIEN INDIVIDUALS REPORT INCOME IN THE SAME, MANNER AS U.S. CITIZENS. CERTAIN INCOME OF NONRESIDENT ALIENS MAY BE TAXED AT A SOMEWHAT HIGHER RATE. FORM 1078 REFLECTS IRC SECTIONS 871 AND 1441 AND REGULATION SECTIONS 1.1441-5 AND 1.871-3 AND 4. IT IS USED BY AN ALIEN CLAIMING RESIDENCE IN THE U.S. FOR INCOME TAX PURPOSES AND MUST BE FILED WITH THE WITHHOLDING AGENT TO CLAIM THE BENEFIT OF RESIDENCE FOR INCOME TAX WITHHOLDING PURPOSES.
