Abstract: IRC SECTION 6044 REQUIRES COOPERATIVES PAYING PATRONAGE DIVIDENDS TO REPORT THESE PAYMENTS TO IRS ON FORM 1099-PATR USING FORM 1096 AS A TRANSMITTAL. CERTAIN CONSUMER COOPERATIVES ARE EXEMPT FROM THIS REQUIREMENT IF THEY FILE FORM 3491 WITH IRS. THE INFORMATION OBTAINED IS NECESSARY TO DETERMINE WHETHER THE EXEMPTION SHOULD BE GRANTED.
