Abstract: SEC. 301(H) OF THE CLEAN WATER ACT ALLOWS EPA TO ISSUE A VARIANCE TO POTW DISCHARGES INTO MARINE WATERS. THIS VARIANCE CAN ONLY BE ISSUED WITH THE CONCURRENCE OF THE STATE FROM WHICH THE DISCHARGE ORIGINATES. SEC. 124-54 COMPLIES WITH THIS STATUTORY MANDATE.
