THE MARINE MAMMAL PROTECTION ACT MANDATES THAT INCIDENTAL TAKING OF MARINE MAMMALS URING COMMERCIAL FISHING OPERATIONS BE REDUCED TO INSIGNIFICANT LEVELS APPROACHING A ZERO MORTALITY RATE. IN ORDER TO REDUCE THIS TAKING, NMFS MUST (1) ASSESS HOW MANY MAMMALS ARE TAKEN ANNUALLY, AND (2) THROUGH RESEARCH FIND METHODS TO REDUCE THIS TAKING. THEREFORE, REGULATIONS WERE PROMULGATED REQUIRING CERTIFICATED FISHERMEN TO REPORT ALL TAKINGS AS CONDITION OF PERMIT.
