Abstract: CERTAIN BENEFICIARIES OF SSI REMAIN UNNECESSARILY INSTITUTIONALIZED BECAUSE RETURNING HOME FOR LESS COSTLY MEDICAL TREATMENT WOULD RESULT IN LOSS OF SSI AND MEDICAID ELIGIBILITY. THE REGULATION PERMITS AN INTRA-DEPARTMENT BOARD TO REVIEW APPLICATIONS SENT BY STATE MEDICAID AGENCIES AND TO DETERMINE THAT SSI DEEMING RULES WILL NOT BE APPLIED THUS ALLOWING DEINSTITUTIONALIZATION WITH MEDICAID ELIGIBILITY RETAINE
