Abstract: 26 U.S.C. 6011 AND 6012 REQUIRE CERTAIN TAX RETURNS BE FILED. 26 U.S. 6401 AND 6402 AUTHORIZE THE IRS TO REFUND ANY OVERPAYMENT OF TAX. IF TAXPAYER CONTACTS THE IRS REGARDING THE NON-RECEIPT OF A REFUND AND A RETURN CANNOT BE FOUND, LETTER 109C IS SENT REQUESTING THE TAXPAYER TO FILE ANOTHER RETURN. ANY REFUND CAN THEN BE MADE AFTER THE RETURN IS PROCESSED.
