Abstract: AN INDUSTRIAL DISCHARGER SEEKING A VARIANCE FOR THE THERMAL COMPONENT OF ITS DISCHARGE MUST SUBMIT A REQUEST DEMONSTRATING WHY SUCH VARIANCE IS JUSTIFIED. EPA WILL EVALUATE THE REQUEST. STATUTORY REQUIREMENT: CWA SEC. 316(A). REGULATORY REQUIREMENT: 40 CFR SEC. 122.53(A)(6).
