CERTAIN STATE LEGISLATORS MAY MAKE AN
ELECTION UNDER SECTION 162(H) TO DEDUCT A GIVEN PER DIEM FOR EACH
LEGISLATIVE DAY IN LIEU OF ITEMIZING ACTUAL BUSINESS EXPENSES FOR
THOSE DAYS UNDER SECTION 162 (A). THE REGULATIONS PROVIDE THAT THE
ELECTION IS MADE BY ATTACHING A STATEMENT TO A LEGISLATOR'S INCOME
TAX RETURN (OR CLAIM FOR CREDIT OR REFUND) FOR THE TAXABLE YEAR FOR
WHICH THE ELECTION IS MADE.
On behalf of this Federal agency, I certify that
the collection of information encompassed by this request complies
with 5 CFR 1320.9 and the related provisions of 5 CFR
1320.8(b)(3).
