BURDEN (AS STATED IN THE SUPPORTING STATEMENT) BECAUSE THE EMPLOYER
HAS TO EITHER RECEIVE OR REQUEST A CERTIFICATION FROM THE STATE
EMPLOYMENT SECURITY AGENCY BEFORE HIRING AN INDIVIDUAL UNDER THE
JOBS CREDIT PROGRAM. ALSO,IT IS UNCLEAR WHERE THE BURDEN ON THE
SESA IN PROVIDING THE CERTIFICATION IS ACCOUNTED FOR. THE FINAL
REGULATION WHICH WILL BE SUBMITTED FOR OMB REVIEW SHOULD ADDRESS
THESE ISSUES.

THE PROPOSED REGULATIONS PROVIDE RULES
AND DEFINITIONS RELATING TO THE DETERMINATION OF THE AMOUNT OF THE
TARGETED JOBS CREDIT. IN ORDER FOR AN EMPLOYER TO CLAIM A CREDIT
FOR WAGES PAID TO AN INDIVIDUAL, THE EMPLOYER MUST OBTAIN A
CERTIFICATION THAT THE INDIVIDUAL IS A MEMBER OF A TARGETED
GROUP.
On behalf of this Federal agency, I certify that
the collection of information encompassed by this request complies
with 5 CFR 1320.9 and the related provisions of 5 CFR
1320.8(b)(3).
