Abstract: A PERMITTEE MAY FILE A REQUEST FOR VARIANCE FORM THERMAL EFFLUENT LIMITATIONS BY DEMONSTRATING THAT NPDES LIMITS ARE MORE STRINGENT THAN NECESSARY TO ENSURE THE PROTECTION AND PROPAGATION OF A BALANCED INDIGENOUS POPULATION OF FISH AND WILDLIFE IN THE RECEIVING WATERS. THE PERMIT AUTHORITY EVALUATES THE REQUEST TO DETERMINE IF THE VARIANC SHOULD BE GRANTED.
