Terms of Clearance: This proposed regulationwould require all effected banks to submit a plan describing the means and schedule by which the bank shall achieve the minimum capital ratios. This universal requirement appears excessive, unduly burdensome, and without practical utility in those situations where the difference between the bank's current capital ratio and the minimum established by the Comptroller can be easily obtained by the bank. The Department should consider alternative approaches that would reduce unnecessary reporting. The Department is to resubmit this regulation for OMB review and approval at the final regulatory stage as required by 5CFR1320.13.
