Terms of Clearance: NOT APPROVED. OMB FINDS THAT FDA'S REQUEST TO COLLECT INFORMATION AS PROPOSED DOES NOT MEET THE CRITERIA FOR APPROVAL SET FORTH IN 5 CFR 1320.4. SPECIFICALLY, FDA HAS PROPOSED COLLECTING DATA OVER AND ABOVE THAT NECESSARY TO DETERMINE WHETHER CORDLESS TELEPHONES PRESENT A PUBLIC HEALTH RISK. FDA'S PROPOSAL IS APPARENTLY DESIGNED TO COLLECT DESCRIPTIVE DATA ON ALL THE CORDLESS PHONES MADE BY THE APPROXIMATELY 120 CORDLLESS TELEPHONE MANUFACTURERS PARTICIPATING IN THIS INVENTORY. WHILE THIS DATA COLLECTION WOULD PROVIDE AN INVENTORY OF ALL CORDLESS PHONES MANUFACTURED, IT WOULD NOT COLLECT INFORMATION RELATING TO ACTIONS TAKEN TO REDUCE PROBLEMS THAT MAY HAVE EXISTED. IN FACT, WE UNDER STAND THAT CORDLESS PHONES WITH RINGERS IN THEIR HEADSETS ARE EITHER NO LONGER BEING MANUFACTURED, OR HAVE BEEN MODIFIED TO ELIMINATE RISKS THAT COULD BE ENCOUNTERED WITH USE OF THE PRODUCTS.

Abstract: THE NEW CORDLESS TELEPHONES ON THE MARKET ARE NOW CAUSING MEDICAL PROBLEMS RELATING TO PERMANENT HEARING LOSS. USER COMPLIANTS HAVE ENSURED BECAUSE OF THIS POTENTIAL PUBLIC HEALTH PROBLEM. FDA MUST COLLECT THIS INFORMATION TO EVALUATE ANY POTENTIAL HEALTH RISK OF A MANUFACTURER'S CORDLESS TELEPHONE AND DETERMINE WHETHER AN INFORMATION CAMPAIGN IS NEEDED OR THE MANUFACTURER MUST TAKE CORRECTIVE ACTION.
