Abstract: IRC SECTION 6661 IMPOSES A PENALTY ON TAXPAYERS FOR THE SUBSTANTIAL UNDERSTATEMENT OF INCOME TAX LIABILITY. THE PENALTY MAY BE REDUCED IF THE TAXPAYER ADEQUATELY DISCLOSES THE RELEVANT FACTS AFFECTING THE TAX TREATMENT OF ANY ITEM ON HIS/HER RETURN, PROVIDED THE ITEMS ARE NO FROM A TAX SHELTER.
