we had raised three major concerns with the agency in our clearance dated 9/19/84, two of which have not been addressed at all in this request for clearance of the proposed recordkeeping requirements dated 11/21/84. First, the need and purpose of the record for safety defect records are not clear in this submission. Other approaches, such as a certification would seem to meet the agency's needs and would impose a lesser burden on the public. Second, the need and practical utility of inspections of equipment on each shift is not clear. We have, therefore, retained the clearance for the recordkeeping requirements in the existing rule through 12/85 at which time the agency will have completed rulemaking. With the submission of the final rule, we will review the agency's response to these concerns as provided in 5 CFR 1320.13 (e) and (g).
